"Just today I was having a masterclass in Media Law, where Samuel Seow, a leading lawyer in the media industry gave a talk on Intellectual Property Laws. Based on what I’ve learnt, the law protects the form and not the idea of a work. So basically, if you have it written down and published, you get automatic copyrights to your work. So in that sense, A.F.K fansub owns the rights to that translation completely. While translations doesn’t sound very much like a big deal of a work, it is still protected under copyright laws. Just like how simple things like roads and even the yellow pages are considered Intellectual Properties." - http://animedesho.animeblogger.net/?p=2593

any work done on a IP(intellectual property) so long as it is not making a profit that will cause the original copyright owner a loss is called a derivative work. This is similar to REmixes by some artist on other artist works.
Yes A copyright is automatically generated on the creation of the work.
However, A group of people can come together and vest their IPs together for a company so that they can get a better profit for their individual IPs.

<a href="http://www.animenewsnetwork.com/news/2007-09-28/singapore's-odex-subs-haruhi-with-similar-text-to-fansub" rel="nofollow">ANN</a> seems to agree with what Anonymous has said though. Copyright laws sure are confusing...

Anyway what does it really matter? I just wish they could copy properly though, there are still spelling and grammatical errors here and there. Copy also can copy wrong =__=""

I'm not too familiar with this, but aren't translations the intellectual property of the translator? As in, you can use the raw, but not the subs. IIRC, you don't even have to apply anything, its automatically copyrighted.
